About these terms.

These Terms of Use apply to the public website operated by Caliber LLC, a marketing and growth firm based in the Kansas City metro and serving organizations nationally. They describe website use, not the full terms of a client engagement. Please also read our Privacy Policy and Cookie Notice.

Information, not a service agreement.

The site describes agency services, fractional leadership, and general marketing perspectives. Browsing, sending an inquiry, subscribing, or receiving an automated acknowledgment does not create a client relationship, reserve capacity, guarantee a response time, or establish a price or scope of work.

Engagements require an appropriate agreement between the parties. Services, deliverables, fees, timing, ownership, confidentiality, and responsibilities are determined by that agreement. An executed agreement governs the engagement if it conflicts with these website terms, subject to applicable law.

Marketing perspectives and results.

Articles and other resources provide general information, not legal, tax, financial, or other regulated professional advice. Marketing decisions depend on the organization, market, budget, execution, and other circumstances. Verify information important to your decision and obtain appropriate professional advice where needed.

Descriptions of services and past experience do not guarantee revenue, leads, conversions, advertising performance, search placement, or inclusion in AI-generated answers. Third-party platforms control their own products, policies, and results.

Work, experience, and illustrative material.

Leadership experience gained before Caliber was founded is distinct from work commissioned from Caliber. A referenced organization or logo does not by itself establish that the organization retained Caliber or endorses every service described on the site. Read the surrounding description for context.

Some visual material is illustrative, digitally created, or edited. Unless identified as actual work, a client engagement, or a team photograph, illustrative scenes are not evidence of a specific engagement, office, event, or result. Images and third-party marks remain subject to their respective owners’ rights.

Intellectual property.

Website text, design, branding, graphics, and other materials belong to Caliber or their respective owners or licensors. You may browse, share links, and retain reasonable excerpts for your own reference or evaluation of our services, subject to applicable law. Other reproduction, resale, publication, or use of branding requires appropriate permission unless permitted by law.

Website terms do not determine ownership of client deliverables. Those rights are addressed in the applicable engagement agreement.

Information you submit.

Provide accurate information and only submit material you are authorized to share. You retain your rights in submissions and permit Caliber and relevant service providers to receive, store, and review them to handle your request, consistent with the Privacy Policy. This is not an unrestricted license to publish your work or use it for unrelated advertising.

Forms and email are initial inquiry channels, not a confidential-document portal or a backup service. Do not send sensitive personal information, trade secrets, or materials requiring special protections until an appropriate method or agreement is in place. Keep your own records. These terms do not override an existing confidentiality agreement or duties imposed by applicable law.

Acceptable use.

Do not attempt unauthorized access, interfere with the site’s operation or security, impersonate another person, submit malicious files or unlawful material, or use forms for spam. Responsible access to public content and ordinary linking are permitted. We may take reasonable steps to prevent misuse and protect the website.

Privacy and external services.

The Privacy Policy describes information practices and available choices. Website use, a contact inquiry, and newsletter signup are not consent to optional analytics or advertising. Tracking choices are handled separately.

External links lead to services with their own content, availability, terms, and privacy practices. A link does not automatically indicate an endorsement. Nothing here excludes responsibilities that applicable law places on Caliber for its own activities.

Availability and limitations.

We aim to provide useful, accurate information, but content can change or contain errors. To the extent permitted by applicable law, the informational website is provided as available, without warranties of completeness, uninterrupted availability, or fitness for a particular purpose. Confirm material engagement details directly with us.

To the extent permitted by applicable law, Caliber is not liable for indirect or consequential losses arising solely from use of, or inability to use, this informational website. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, or overrides responsibilities under a separate signed agreement.

Updates and contact.

Updates apply prospectively from the date shown above. They do not retroactively amend an executed agreement or substitute for notice or acceptance required by applicable law.
